Sexual Harassment Risk Spurs NSW Venue Crackdown

SafeWork NSW has recently issued 16 improvement notices to 11 hospitality venues across New South Wales following a two-month compliance initiative targeting workplace sexual harassment risks. This action was part of the regulator’s Respect at Work Taskforce’s efforts to assess 38 venues for their management of work health and safety (WHS) concerning sexual harassment.

The inspections revealed that while 92% of venues had systems to identify sexual harassment risks, many lacked comprehensive control measures. Common deficiencies included inadequate staff consultation on WHS measures, insufficient training on managing bar-related risks, and a lack of detailed risk assessments specific to sexual harassment. Additionally, although most venues had reporting pathways for incidents, few had robust systems to investigate and address complaints effectively.

SafeWork NSW Director of Capability and Engagement, Christina Hey-Nguyen, emphasized the heightened risk hospitality workers face due to factors like alcohol service, late-night work, and close customer interactions. She stated, “This inspection program across 38 NSW hospitality venues demonstrates that progress is being made; however, more needs to be done, including in leadership, training, reporting, and work design, to ensure the health and safety of hospitality workers.”

To assist businesses, SafeWork NSW offers resources such as the NSW Code of Practice for sexual and gender-based harassment and a tailored “how-to” guide for hospitality venues. Workers are encouraged to report unsafe practices to their employers or, if necessary, to SafeWork NSW through the “Speak Up Save Lives” platform or by calling 13 10 50.
